Online tennis equipment retailer Midwest Sports Supply LLC's use of the Tennis Point name does not infringe the trademark rights of a company that sells tennis tournament software under the Tennispoint brand, Midwest said in a lawsuit filed in the Southern District of Ohio.
Midwest has the authority to use the Tennis-Point and Tennis Point trademarks because its majority-owned company, SIGNA Sports Unlimited GmbH, previously acquired majority ownership of Tennis-Point GmbH, according to the complaint filed Tuesday in the US District Court for the Southern District of Ohio.
