A federal district court lacked jurisdiction to block construction of the Cardinal-Hickory Creek power line through a Midwest wildlife refuge, the Seventh Circuit ruled, dismissing the lawsuit.
The U.S. Fish and Wildlife Service has not made a final decision on transmission developers' requests to build the $500 million, 101-mile transmission line through the Upper Mississippi River National Wildlife Refuge, so the lower court could not review the decision, the court said.
